E-Commerce in Light of International Trade Agreements: The WTO by Bashar Malkawi


E-Commerce has developed after the creation of the WTO in 1994. Consequently, the WTO does not contain specific articles for e- commerce. Nevertheless, there are several WTO agreements related to e-commerce. These WTO agreements include the General Agreement on Trade in Services (GATS) and the Information Technology Agreement (ITA).

The GATS is of particular significance to e-commerce for several reasons. First, the communication services which provide access to e-commerce fall under the GATS.Second, the execution of an electronic transaction necessitates infrastructure services (distribution, payment, etc.) whose liberalization equally falls under the GATS. In view of the acknowledged importance of telecommunication services, the access to public telecommunication networks was incorporated in a separate telecommunication annex.In addition, WTO members agreed to so-called Reference Paper. The Reference paper provides for rules that shall prevent anti-competitive behavior in the telecommunications sector.The Reference Paper includes competition policy principles to ensure access to public telecommunication networks.

The ITA is of a particular significance to e-commerce. WTO members agreed to a common position with regard to trade in information technology (IT) goods. WTO members committed themselves to reduce their tariffs on IT-goods in four steps of twenty-five percent to reach a tariff-free policy by the year 2000.This obligation pertains to a common list of IT-products covering wide range of some 180 information technology products in five major categories: computers and peripheral devices, semiconductors, printed circuit boards, telecommunications equipment (except satellites), and software. The IT covers ninety-five percent of the existing world trade in IT-goods. Thus, the ITA brings advantages to a wide range of production activities.

Largely at the insistence of the U.S. at the WTO Ministerial Conference in 1998, WTO members decided to develop a work program covering e-Commerce.

According to the WTO Work Program on Electronic Commerce, e-commerce is understood to mean the production, distribution, marketing, sale or delivery of goods and services by electronic means. The WTO divides e-commerce transactions into three distinctive stages: the advertising and searching stage, the ordering and payment stage, and the delivery stage. Any or all of these stages may be carried out electronically and may therefore be covered by the concept of e-commerce. In other words, a buyer may purchase a book via the Internet and to be delivered physically later on or he can purchase and download the book via the Internet. In either case, the purchase of the book could be said that it is conducted through e-commerce means.

Despite the fact that the WTO Work Program on Electronic Commerce has been set up in 1998, very little progress has been achieved. The most important issue blocking progress on e-commerce in the WTO agenda is the question of categorization. WTO members differ whether products which were usually sold as goods due to their link to a physical carrier and which can now be delivered online over the net (e.g. music or movies) shall be treated as goods under the General Agreement on Tariffs and Trade (GATT) or as services under the GATS.For example, if a book is ordered online, but is delivered physically, for the purposes of WTO trade rules, it is a good. That makes it subject to the GATT. However, if the book is delivered electronically - downloaded onto the computer � it is unclear whether this digital product should be treated as a good or a service. If goods delivered online were considered goods, they would be subject to few trade restrictions under the GATT such as tariffs .On the other hand, if goods delivered online were considered services, they would be subject to more trade restrictions under the GATS such as market access barriers and discriminatory domestic regulations. For example, if the delivery of films and broadcasts on the Internet is considered services, countries apply their restrictive rules on the distribution and broadcast of audiovisual works to films and television programs transmitted over the Internet. Until the classification debate is resolved, WTO members decided not to impose tariffs on imported electronic transmissions.

There were numerous WTO meetings and seminars producing views and proposals which are reflected in the country statements or the final reports.These meetings would include informal exchange of view-points than the achievement of agreements. Therefore, the classification debate issue continues to be unresolved. There have been no new e-commerce relevant actions at the WTO until now.





Advantages of Technology in Internation Trade


Technology plays a major role in international trade. Databases, overnight delivery and faxes have opened the world market to not only larger companies but small ones too. To add to this globalization, companies and even competitors are combining and forming alliances to cut cost and increase the profit margin. Chrysler, General Motors and Ford have formed an alliance in research and development to avoid duplication. These alliances are not only with domestic companies but they also go over national lines. Companies are pushing for integration of the world economy in hope for increased profits and governments are beginning to listen.

Since 1986 (GATT) General Agreement on Tariffs and Trade have taken the incitive to move towards the liberalization of international trade. GATT members agreed to reduce tariff and non-tariff trade barriers. From 1986 to the present due to GATT's lead many markets have been open to the United States increasing exports and increasing efficiency through competition.

One of the most aggressive liberalization groups to follow GATT's lead is APEC (Asian Pacific Economic Community). APEC consist of 18 countries that account for 1/2 of the worlds output. The three largest economies Japan, China and the United States are members. APEC leaders are committed to achieving free and open trade for the region by 2010. APEC is moving towards this goal through many means including accelerating initial Japanese tariff cuts by 50%. China will also cut a number of tariffs by 30%. Indonesia and other APEC members are also reducing tariffs sharply. What sets APEX at the head of the pack leading liberalization is it wiliness to extend benefits of membership to everyone. APEX is willing to extend the benefits of cuts in tariff and non-tariff barriers to all countries willing to make comparable cuts. This is a major incentive for all countries because the Pacific Rim is the fastest growing market in the world and large profits are to be made there.

To put these cut in trade barriers in perspective lets look at the company Chrysler. Chrysler is introducing a right handed drive version of the neon subcompact to the Japanese consumer. Chrysler plans to sell 4,000 units at their 200 show rooms. They are hoping for even more success with the right handed versions of the Voyager and Wrangler which they plan to introduce next year. With Japanese subsidizes on exports which lead to a high price on Japanese domestic goods, Chrysler should be very competitive.

Liberalism in trade, though progressive vary a lot with area. The European Union consisting of the countries of western Europe have established a free trade zone between themselves but those areas outside the union deal with the same old trade barriers. Tariffs on sensitive goods still remain. Sensitive goods range from agriculture and raw materials to footwear and furniture. These practices may seem unfair but the union is beginning to open up trade with Eastern Europe, the Mediterranean and hopefully they will take the APEX incentive to open thier market. If not we have policies that we can follow to force free trade.

The United States is in a unique position in the world economy being the largest consumer nation and also a major exporter. The U.S. can use the threat of trade sanctions to open up closed markets and even change countries policies. An example of this is the U.S. threat to use trade sanctions towards China. China has a booming industry pirating U.S. films and music. This industry cost the U.S. billions. The threat of trade sanctions forced China to crack down on these pirating industries.

The world is moving towards the liberalization of international trade. Large economic communities are being formed to make trade more profitable for everyone involved. The APEC initiative takes this even farther with plans to incorporate the whole world into a free trade area, thus making the entire world more efficient and goods less costly.





Compromise reached in US/Mexico cross-border trucking


U.S. President Barack Obama and Mexico President Felipe Calderon announced yesterday that they have come up with a solution that will "allow for the establishment of a reciprocal, phased-in program built on the highest safety standards that will authorize both Mexican and United States long-haul carriers to engage in cross-border operations under NAFTA." Mexico will suspend 50% of its retaliatory tariffs when the new agreement is signed (60 day estimate) and the other 50% when the first Mexican carrier is granted operating authority under the program.

President Calderon is wise to make sure we hold up our end of the bargain before taking down the tariffs. Negotiators from both sides are working on a draft agreement that the DOT will review with Congress and put out for public comment.

It is unlikely that we will be seeing the benefits of this new compromise any time soon. While details are still being worked out, at least some components of the prop osal are known. Mexican truckers will be required to operate with Electronic On-Board Recorders (EOBRs) that ensure compliance with U.S. hours of service regulations and to ensure that the trucks only haul freight to and from Mexico, not U.S. domestic freight.


Under the agreement, Mexico would eventually lift tariffs it placed on dozens of U.S. products in response to the banning of its trucks from U.S. roads, AP said.Leaders from both countries will negotiate further details of the plan, which will be phased in, and the deal will require approval from the U.S. Congress before it takes effect, Bloomberg reported.American Trucking Associations is "pleased" that the leaders have come to an agreement, President Bill Graves said in a statement."When properly implemented, NAFTA's trucking provisions should evolve to allow for a more efficient, safe and secure environment for cross-border operations between the U.S. and Mexico," Graves said.

The Owner-O perator Independent Drivers Association, which has consistently opposed the plan, said in a statement it was "outraged" by the proposed agreement."For all the president's talk of helping small businesses survive, his administration is sure doing their best to destroy small trucking companies and the drivers they employ," OOIDA said.





Tariffs and Limits


Today's news is dominated by political parties posturing as if they know how to solve pressing
problems with real answers. What we see happening in Wisconsin is only the beginning of desperate actions to come if we don't begin to come up with real long-term jobs. Is the pay scale we receive for a job important? Sure it is, but without jobs the pay scale does not matter. Politicians don't seem to get the effects of losing somewhere between 9% and 20% of our jobs. If we were at a 6% jobless rate, we wouldn't be experiencing mobs of people protesting the inability of states paying for all their financial commitments. Trade agreements are in place with every country in the world that wants to do business with the US. Probably the best known in the last two generations would be NAFTA, the North American Free Trade Agreement and this is only a sampling of the problems with these agreements. According to Wikipedia, "The goal of NAFTA was to eliminate barriers of trade and investment between the US, Canada and Mexico. The implementation of NAFTA on January 1, 1994, brought the immediate elimination of tariffs on more than one half of U.S. imports from Mexico and more than one third of U.S. exports to Mexico. Within 10 years of the implementation of the agreement, all US-Mexico tariffs would be eliminated except for some U.S. agricultural exports to Mexico that were to be phased out in 15 years. Most US-Canada trade was already duty free. NAFTA als o seeks to
eliminate non-tariff trade barriers." NAFTA eliminated tariffs, a key tool in controlling the loss of jobs and generating much needed revenue to level the playing field.

Tariffs can be used to level the playing field for all countries involved. When imports are coming into this country at such a low cost that it creates an imbalance between those products and the products being manufactured here, import tariffs can be used to bring costs back in balance. These tariffs also will help to reduce the income tax rates. Lower income taxes allow for more spendable income, increasing economic stability. The same thing can be done for exports in the same manner. That's my thoughts, what's yours?

Effects on the US Economy

Inhabitants of the United States purchase more foreign goods than they manufacture for shipment abroad. This ensures that our national trade balance is a trade deficit. We sent $46.3 billion more abroad for goods in January of 2011 alone. This means there is a flood of US dollars going abroad. This reduces the value of the dollar on currency exchanges.

Because of the mediocre economy and the uninhibited spending by the Federal government, 42 cents o f every dollar Congress spends has to be borrowed. Because of this, the United States is the foremost debtor nation of all time.

The upshot of all this is that the economic stability of the United States is starting to become increasingly questionable. The mounting price of gold, a standard of value, demonstrates that the US dollar is swiftly losing value. With hope that the federal government will change course dimming, the future for the dollar and the investments of millions of Americans looks darker and darker.

The Canadian standard WHMIS �Workplace Hazardous Material Information System� is implemented through coordinated federal, provincial and territorial legislation. Supplier labeling and MSDS requirements are set out under the federal �Hazardous products Act� and associated �Controlled Products Regulations�. All of the provincial territorial and federal agencies responsible for occupational safety and health have established WHMIS employer requirements within there respective jurisdictions. These requirements obligate employers to ensure that controlled products used, stored, handled or disposed of in the workplace are properly labeled, that MSDSs are made available to workers, and that workers receive education and training to ensure the safe storage, handling, use and disposal of controlled products in the wor kplace.

The United States standard �29 CFR 1910.1200 - Occupational Safety & Health Administration� as well as the Mexican standard �NOM-018-STPS-2000� are also concerned with protecting the safety, health and welfare of people engaged in work or employment. The goal of all these standards is to foster a safe work environment. As a secondary effect, it may also protect co-workers, family members, employers, customers, suppliers, nearby communities, and other members of the public who are impacted by the workplace environment.

The North American ANSI standard �ANSI.Z400.1-2004� applies to the preparation of MSDSs for chemicals and materials used under occupational conditions. It presents basic information on how to develop and write MSDSs that are complete, clear and consistent. It also identifies information that must be included to comply with the HCS. Additional information is provided to help comply with state and federal environmental and safety laws and regulations. With the addition of certain data elements, this Standard is also acceptable for international use.

What all of the above standards have in common is to author a fully NAFTA MSDS complaint document which can be used through out the whole North American continent. It meets the required regulations for three countries Canada, United States and Mexico which have joined the free trade agreement in order to create a free way of chemical trading.





Mexican and Canadian NAFTA Professional Workers Can Get A TN Status


Canadian and Mexican citizens take the privilege of getting a TN Visa to work in the United States. TN status is a special status given to non-immigrant Canadian and Mexican NAFTA professionals. The North American Free Trade Agreement (NAFTA) is an agreement signed by the governments of Canada, Mexico, and the United States to allow the professionals of certain occupations of each country to work in each other countries.

What Canadians Require for Acquiring TN Status?

Canadian citizens usually do not need a visa as a NAFTA Professional, although a visa can be issued to qualified TN visa applicants upon request. A Canadian citizen without a TN visa can apply at a U.S. port of entry. A Canadian residing in another country with a non-Canadian spouse and child would need a visa to enable the spouse and child to be able to apply for a visa to accompany or join the NAFTA Professional, as a TD visa holder. Canadian professionals are admitted into the USA in the TN-1 status.

What Mexicans Require for Acquiring TN Status?

Mexican citizens require a visa from a consulate in Mexico to request admission to the U.S. Once the TN visa stamp is obtained in the Mexican citizen's passport, they may enter the US in TN status in a similar manner to a Canadian citizen, and are admitted into the US in the TN-2 status.

A TD visa is required for spouses and children (unmarried children under the age of 21) who are accompanying or following to join NAFTA Professionals (TN visa holders). A bona fide spousal or parent-child relationship to the principal TN visa holder must be demonstrated by the applicants. Applicants do not have to be citizens of Mexico or Canada. Spouses and children cannot work while in the U.S. though they are permitted to study.

The United States Food and Drug Administration and Nafta


The North American Free Trade Agreement (NAFTA) helps safeguard the ability of the United States Food and Drug Administration to ensure food safety and quality within North America. NAFTA is an agreement between Canada, the US and Mexico that took effect on January 1, 1994, designed to increase the scope for the free flow trade and investment among these three countries. The US Food and Drug Administration (US FDA), which participated in the negotiation of NAFTA, has reviewed the US Food and Drug Administration standards for safety, purity and appropriate labeling of foods and has determined that these standards are consistent with the terms of the agreement. This is why no changes in US Food and Drug Administration standards are needed or proposed to implement NAFTA.

NAFTA does not change existing or future US Food and Drug Administration standards regarding pesticide use or pesticide and other chemical residue or contaminant standards for fresh or processed foods. NAFTA provisions safeguard the ability of the US Food Drug Administration to ensure food safety. In short, existing US Food and Drug Administration standards will continue to be applied to imported foods as well as domestically produced foods. This means that the U.S. will continue to prohibit any food shipments determined not to meet pesticide residue or other food safety requirements.

NAFTA has no effect on U.S. Food and Drug Administration laws and regulations in the area of safety, effectiveness, and appropriate labeling of human and animal drugs and medical devices. Any products coming into the U.S. must continue to meet all US FDA standards and requirements.
Additionally, NAFTA does not change or affect US Food Drug Administration laws and regulations with respect to US Food and Drug safety and appropriate labeling of dietary supplements imported in to the U.S.

U.S. FDA and TWG

Within the auspices of the NAFTA, the three countries have developed a technical working group on pesticides called TWG. It serves as a focal point for all issues related to pesticides for these countries. TWG's aim is to ensure that the countries can be assured of the legality and safety of foods produced in any of the NAFTA countries. US food and drug administration is providing trilateral cooperation between Mexico and Canada to enforce the TWG standards.

Article 723(6) makes explicit that any party challenging a U.S. Food and Drug Administration safety measure would have the burd en of showing that the US Food and Drug measure is inconsistent with NAFTA. Whether any particular level of protection is "appropriate" is a social and political judgment that the agreement reserves for the government applying the measure (see Articles 712(2) and 724). As provided in Article 712, a sanitary measure is to be based on a risk assessment "as appropriate to the circumstances," and is not to be maintained where there is no longer a scientific basis for it. US Food and Drug Administration standards are already based on risk assessments and have a scientific basis. These NAFTA requirements help assure that measures applied by the other parties will not unfairly exclude U.S. food exports.

Like many Mexicans, Estrada says there is little to celebrate in Mexico today, with its violence, corruption and inequity. Yet in another way, the harshly critical movie shows how far the country has come - it was made with government funding, and nobody tried to censor it.

"I think this should be seen as enormous progress," Estrada says.

As Mexico limps into the bicentennial of its 1810 independence uprising, it is battered and full of self-questioning, but with more openness and debate than perhaps at any other time in its history.

The bicentennial marks the 1810 uprising led by Catholic priest Miguel Hidalgo, who gathered a band of Indians and farmers under the banner of the dark-skinned Virgin of Guadalupe. He was caught and executed soon afterward, but by 1821 the movement he started ousted the Spanish, a feat Mexicans celebrate Sept. 15-16.

"A bicentennial should inspire and generate hope, and this one hasn't," notes longtime environmental and consumer activist Alejandro Calvillo. "It comes at a time of deep crisis."

Why couldn't it have been in 1977, when Mexico was flush with oil money? Or in 1993, when Mexico negotiated the North American Free Trade agreement with the U.S., portrayed as a ticket to prosperity? Or in 2000, when the country experienced the first democratic transition of power in its history?

But all those "victories" proved hollow. The oil is running out. NAFTA failed to lift Mexican wages or stem migration. And democracy - in a country with no ballot initiatives, independent candidates or open city council meetings - has only strengthened the grip of the three main political parties.

A Pew Research Center poll released in August shows 79 percent of Mexicans are dissatisfied with the country's direction. Even U.S. Secretary of State Hillary Rodham Clinton jumped into the fray last week, saying that Mexico, plagued with drug-running and violence, is looking more and more how Colombia looked two decades ago.

Mexico seems to be slipping behind: Chinese auto workers who once earned wages their Mexican counterparts wouldn't stoop to take now earn more. Mexico's cherished role as defender of Latin America's right to self-determination has largely been taken over by Brazil and Venezuela. Perhaps what Mexicans have to celebrate is their own endurance - the real glue that's held the country together for centuries.

"We won't migrate, and we won't allow ourselves to be defeated," says Victor Suarez, 57, who started a national farm cooperative movement in 1995, right after NAFTA opened the door to imports of U.S. grain. Suarez' group now negotiates better prices for about 60,000 small farmers, and has built 200 grain warehouses.

"Farmers are the country's future," he says. "We are fighting to save something that is key to the national identity."

Yet in the past 15 years, Suarez says he's seen increasing numbers of poor farmers migrate to the United States, or be recruited by drug gangs to work as hitmen or lookouts, or to plant marijuana or opium. In a country where roughly 10 percent of the population has migrated abroad - and a Pew Research Center poll shows another 33 percent would like to do so - merely remaining is often a statement in itself.

That's especially true in Ciudad Juarez, where drug violence has killed more than 4,000 people since 2009, making it one of the deadliest cities in the world. The violence is so bad that the city canceled its Independence Day celebration for the first time since Pancho Villa raided towns along the border during the 1910-1917 Revolution.

A restaurant owner in the violence-wracked border city - he asked for his name not be printed to avoid reprisals - isn't leaving, even after gunmen barged into his eatery one year ago to demand protection money. He moved his family to El Paso, Texas and opened another eatery there, but he remained in Juarez to keep his business open and continue providing jobs for his 10 employees.

"My dad started this place on a shoestring," he says, amid the warm smell of his family's turkey burritos. "I want to stay here, I'm from Juarez, and I'm going to stay and help my employees' families as long as I can....I'm not going to let some bastards run me out."

Mexicans are losing faith in many institutions. After the hero in Estrada's movie bursts into a bicentennial celebration and mows down corrupt figures - a drug lord, a mayor, police chief and local priest - with an assault rifle, audiences in Mexico City clapped.

But the search for new values is somewhat disorienting. For most of its 200 years, Mexico was dominated by three institutions, whose buildings loomed over hundreds of town squares: the church, the city hall and the house of the most prominent family.

The church - whose falling number of priests can hardly serve their flocks anymore - now strives to be relevant in a country where most still list themselves as nominally Catholic, but hardly ever attend mass anymore.

Rev. Alejandro Solalinde runs a shelter for Central American migrants in the southern state of Oaxaca, where he has braved threats from corrupt officials and drug gangs. Even Solalinde questions his church and his country's direction.

"I think that nationalism isn't much help any more," he said. "I think what we need is new humanism, that places value on the individual human being."

Today, one of the buildings on a Mexican town square is likely to be an evangelical temple. Evangelical and Protestant groups provide involvement and a sense of revivalism, holding "prayer meetings for peace" in places like Ciudad Juarez.

Other aspects of life are changing; today, a Mexican town square is likely to hold an Internet cafe, a money exchange for migrant remittances, and a store selling plastic Chinese sandals instead of leather huaraches.

The family remains a bulwark, albeit one that is often split by mass migration. But the enormous, close-knit Mexican family may be a thing of the past; Mexico's birth rate has fallen from about 7 children per woman in the late 1960s to 2.1 today.

Upper-middle class Mexicans today are firmly implanted in the developed world, with iPhones, modern apartments, high education levels and small families. They sometimes feel ignored amid all the talk of violence: Mexico's nationwide murder rate, after all, is a relatively low 14 per 100,000, well below the average for Latin America.

"The dangerous, violent, tragic, corrupt and cynical Mexico is not the country most Mexicans belong to," philanthropist Manuel Arango wrote in an open letter in August. "The millions who go to work everyday, despite street protests that often block traffic, who work to get ahead and support their families... this invisible Mexico is the real Mexico."

Today, Mexico has strong civic movements on issues like crime, human rights and environmental protection that didn't exist 25 years ago. And despite suffering the most severe recession since the 1930s in 2009, the country has sound government finances and growing accountability. There is also now a truly independent Supreme Court.

Yet a few rich still hold the reigns of the country's highly concentrated economy, where one or two firms dominate key sectors like television, telephones, cement, and food distribution. Half of the country's 107 million people live in poverty. Mexico is home to both the world's richest man, Carlos Slim, whose fortune is estimated at about $53.5 billion, and about 20 million Mexicans who live on less than $3 per day.

In the meantime, social activists are trying change Mexico in various ways. Mothers whose children disappeared in counterinsurgency or police campaigns have taken to washing the Mexican flag in a tub of water outside the steps of the country's Supreme Court in the weeks leading up to the bicentennial. And some are trying to use the courts to introduce class-action lawsuits taking on big business. But activism can only do so much; for example, antiquated labor laws make union organizing nearly impossible, and wealth and power often prevail in Mexico's bureaucratic, opaque court system.

"It's a contradictory situation, because on the one hand, people are a little desperate and want to participate, but the lack of democratic processes discourages that," Calvillo said.
